Mr. Abdul Razzak advocate for the petitioner

Mr. Ali Haider Saleem A.P.G

  -------------------------

Through this petition, the petitioner has prayed that directions may be issued to the learned trial court for concluding the trial expeditiously as for last three years, the matter is pending in the A.T.C Court No.III, Karachi.

2.      On last date of hearing, we called the progress report from learned trial court. Learned A.T.C Court No.III, Karachi has submitted the progress report in which it is stated that after framing of charge, nine (09) witnesses have been examined and 28 witnesses are to be examined more. It is further stated that sometimes matter was adjourned due to absence of learned counsel for the petitioner and sometimes due to strike of Bar Council as well as non production of witnesses by the I.O. However, learned trial court assured that matter will be proceeded expeditiously. Here we would like to observe that the courts are aware that much emphasize has been made in National Judicial Policy for the early disposal of the criminal cases but in this case, we feel some inordinate delay.

3.      Learned A.P.G submits that directions may be issued to the learned trial court for expediting the trial and disposal of case.

4.      In view of above, this petition is disposed of with the directions to the learned trial Court to conclude the trial expeditiously and pass judgment on merits preferably within a period of three (03) months with compliance report through MIT-II of this Court. Petition is disposed of accordingly.

5.      Copy of this order be transmitted to learned A.T.C Court No.III, Karachi.
