Through instant petition, the petitioner has expressed his grievance with regard to proposed action by the respondents whereby as per petitioner, the respondents are attempting to shift head regulator of Galsi distry and to construct new channel to remove curve of Galsi distry over the land of petitioner without acquiring the same as per law.

Notices were issued, pursuant to which, comments have been filed by the respondents. Learned AAG has drawn the attention of the Court to the comments filed by respondent No.2/XEN Northern Dadu Division, Larkana and referred to reply of Para-8 which reads as under :-

The contents of Para No.8 of the constitutional petition are denied. It is submitted that the work has not yet been started at the site until complete codal formalities are not fulfilled.

Learned AAG submits that the proposed action shall be taken strictly in accordance with law after fulfillment of all the codal formalities, whereas, presently, per learned AAG no work is being carried out on the said distry. It is further stated that if the land of petitioner will be utilized for such purpose all the codal formalities will be complied with and the proposed action shall be taken strictly in accordance with law as per rules and regulations.

In view of the comments as referred to hereinabove and the statement of learned Addl. A.G., counsel for the petitioner is satisfied and does not press instant petition which is accordingly disposed of along with listed application.
