Counsel for the petitioner submits that he has not pressed petition against respondents except the respondent No.5 and submits that he will not press instant petition provided the respondent No.5 may be directed to fulfill their contractual obligation.

Assistant Engineer Highways Sub-Division, Shahdadkot appearing on behalf of XEN Highways Division, Kamber-Shahdadkot, present in Court, submits that the contractual obligations of the running contracts are being made by the respondents, however, on account of paucity of funds some time the delay is caused.

Learned Addl. A. G., submits that though instant petition is not maintainable, as the petitioner is seeking a declaration for enforcement of a running contract, however submits that the respondents shall act as per the statement dated 4.12.2013 filed by respondent No.5 in the instant matter.

Petition stands disposed of in the above terms.
