3. Through instant petition the petitioner alleges illegal detention of detenue Nizamuddin son of Mor Khan Khokhar by SHO PS Rehmatpur, Larkana. It has been contended by the learned Counsel for the petitioner that the SHO PS Rehmatpur, Larkana raided the house of petitioner and took away his cousin, namely, Nizamuddin son of Mor Khan Khokhar inspite of the fact that there is no case registered against the petitioner or the detenue. It has been prayed that the commissioner may be appointed to conduct raid at Police Station Rehmatpur, Larkana, who shall recover the detenue Nizamuddin and produce him in Court on the next date if he is not required in any case.

Mr. Muhammad Yousuf Panhwar, P.A to Judge of this Court is appointed as commissioner to pay/conduct surprise visit at Police Station Rehmatpur, Larkana, and if no record is found available to connect the alleged detenue with any crime, then he shall be released forthwith with direction to the detenue to appear before this Court on 04.2.2014, at 08.00 a.m., when the respondents No.1 shall also appear alongwith relevant record. In case, any record is found available at police station, then the respondent No.1 shall be directed to produce alleged detenue before this Court on 04.2.2014, together with relevant record. The fee of Rs.3000/- be paid by the petitioner to the commissioner in advance. In the meantime, notice may also be issued to the Addl. A. G. Necessary protection will be provided to the commissioner for conducting raid at P.S Rehmatpur, Larkana.
