Through instant petition, the petitioner has sought direction to the respondent No.1 i.e., SHO PS Wagan to submit report before the Judicial Magistrate-I, Warah, where the proceedings initiated on the complaint of petitioner are pending. It has been further stated that the Judicial Magistrate may be directed to pass the order on the application of petitioner filed under Section 523, Cr.P.C for the release of buffaloes.

From the perusal of the contents of this petition it is observed that neither any adverse order whatsoever has been passed by the concerned Magistrate on his application under Section 523, Cr.P.C, nor the petitioner placed on record any material or case diary of the case pending before the Judicial Magistrate–I, Warah to show that inordinate delay has occurred on account of inaction by the respondents.

Since the proceedings are already pending before a forum of the choice of petitioner, therefore, we are not inclined to interfere in such proceedings. The petitioner may approach the concerned Judicial Magistrate where the legal proceedings are pending, who shall enforce the orders passed by him in accordance with law and may dispose of the same within a reasonable time. Petition has no merit, which is accordingly dismissed in limine alongwith listed applications.
