            Pursuant to court’s and directions issued to SSP Shikarpur to trace out the whereabouts of alleged detenues namely Saifullah and Salman and to produce them in Court, SIP Imdad Ali SHO PS Sharif Kharos has shown appearance and filed latest progress report duly signed by the SSP Shikarpur along with its annexures, copies of the same supplied to counsel for the petitioner.

            Leaned APG submits that wife of one of the alleged detenues namely Noor-ul-Haque filed an application under Section 22-A, Cr.P.C before the learned Sessions Judge/Ex. Officio Justice of Peace, Shikarpur about the alleged abduction of the detenues including Saifullah and Salman against the police officials on which application directions have been issued by the learned District & Sessions Judge/Ex.Officio Justice of Peace, to register the case and accordingly, an FIR No.01/2014 has duly been registered at Police Station Sharif Kharos. Learned APG submits that since proper remedy has already been availed by petitioner, the instant petition may be disposed of with the directions to the I.O of the aforementioned FIR to investigate the case and furnish report or submit challan before the competent court of jurisdiction in accordance with law.

            Learned counsel for the petitioner does not oppose disposal of instant petition in the aforesaid terms, however, he submits that the investigation of the aforesaid FIR may be directed to be made by an officer not below the rank of DSP.

            In view of hereinabove we would dispose of instant petition with the directions to the concerned SSP to assign the investigation of aforementioned FIR to an officer not below the rank of a DSP of good reputation who shall investigate into the matter and submit report or challan before competent court of jurisdiction in accordance with law. The progress report of aforesaid FIR shall be submitted to this Court through Additional Registrar preferably within one month.

            Petition stands disposed of in the above terms.
