            Pursuant to Court notice, the respondent No.3 has shown his appearance and claims copy of the petition; he requests for time to file comments.

            Learned counsel for the petitioner submits that he will be satisfied and will not press instant petition provided that respondents may be directed to issue tender form to the petitioner as he has already deposited the call deposits in the bank and also qualifies for the subject tender. The Executive Engineer, Highways Division Shikarpur present in Court states that if the petitioner has deposited the call deposits and qualifies for the subject tender, the same will be issued to him in accordance with law and as per rules today.

            In view of such position, the petition stands disposed of.
