Through instant petition the petitioner has sought reinstatement into service as Drawing Teacher Govt. Girls High School, Mahota and has sought directions of this Court to Head Mistress Govt. Girls High School, Mahota who vide letter dated 7.10.2002 directed the petitioner not to attend the school any more whereas, salary of the petitioner was also stopped.
Learned counsel for the petitioner submits that the directions of the Head Mistress Govt. Girls High School, Mahota whereby the petitioner was restrained from attending the school are illegal, hence she may be directed to take back the petitioner into service and to allow the petitioner to continue performing her duty in school as Drawing Teacher.
Learned AAG has raised an objection with regard to maintainability of instant petition on the point of latches and has also drawn the attention of this court to the said letter as referred by the learned counsel for the petitioner and submitted that in fact the services of the petitioner were terminated by the EDO Education, Larkana vide office letter No. EDO(E)W.B./238-16/2002/Larkana dated 24-9-2002 as the appointment of the petitioner was illegal. Learned counsel for the petitioner was directed to assist this court as to whether termination of the petitioner was challenged before the competent authority or any court of law however, learned counsel for the petitioner could not refer to any such representation or proceedings filed against such termination by the petitioner.
In view of hereinabove facts, we are of the view that instant petition is devoid of merits, which otherwise suffers from latches which are not explained. Accordingly, petition is dismissed in limini along with listed application.
