Pursuant to court notice, Deedar Ali Leghari, Executive Engineer, Provincial Highway Division, Larkano has shown appearance and submits that petitioner is not eligible to participate in the tender which is meant for construction of road, as the petitioner does not possess the requisite prequalification. Learned AAG submits that in view of the documents filed by the petitioner i.e. licence issued in favour of the petitioner by Pakistan Engineering Council which shows that the field of specialization of petitioner is CE-04 CE-09 and CE-10 which relate to Irrigation, Public Health and other work except construction of road. It is further stated that for the purposes of licence and experience for construction of road specialization in CE-01 is required. The officer present in Court further submits that the tender forms were issued only to the participants who possessed the prequalification and had the experience of CE-01 whereas tenders have already been opened on 11.2.2014 and the matter is under process per law, rules and regulations.

Learned counsel for the petitioner submits that the respondents shall be directed to ensure to abide by such statement and to process the tender strictly in accordance with law and as per rules failing which the petitioner will be entitled to file the appropriate proceedings.

In view of hereinabove the petition stands disposed of. However, the respondents are directed to act strictly in accordance with law and to ensure that the entire process of issuing tender shall be transparent and in accordance with Sindh Public Procurement Rules, 2010.
