After arguing the matter at some length, learned counsel for the petitioner submits that the petitioner will be satisfied and will not press the instant petition provided the respondents may be directed not to disturb the existing taxi stand whereas the members of the petitioner’s union may be provided some accommodation for the purposes of waiting and relaxing of the petitioner’s members i.e. private taxi drivers during their stay at the taxi stand.
Ghulam Hussain, the Station Master, Railway Station, Larkana is present in Court and states that presently respondents are not willing to disturb the taxi stand which is constructed on Railway’s land, nor to dislodge the private taxi drivers however, he submits that said taxi stand will be given to successful bidder in open auction which is scheduled to be held on 17.02.2014, whereas petitioner is at liberty to participate in such open auction. It is further stated that as regards their claim for further accommodation for the purposes of labour hall or room for waiting and relaxing during working hours, they may approach the D.S Railway Sukkur who will consider their request in accordance with the law keeping in view the availability of such accommodation near taxi stand.
In view of hereinabove, petition stands disposed of. Respondents may auction the subject taxi stand after complying with all codal formalities whereas the petitioner is at liberty to participate in such open auction. Petitioner may also approach the D.S Railway, Sukkur with regard to any other claim regarding accommodation for the purpose of waiting and relaxing by the private taxi drivers during working hours near existing taxi stand, which may be permissible under the law and rules and the D.S Railway, Sukkur may consider the same as per law.
