DATE OF HEARING |
ORDER WITH SIGNATURE OF HON’BLE JUDGE. |
17.01.2014.
1. For orders on office objection.
2. For Katcha Peshi.
Mr. Sajid Hussain Mahessar, advocate for the petitioner, alongwith the petitioner.
Mr. Riaz Hussain Khoso, State Counsel, alongwith SIP Raza Muhammad Sohu on behalf of SSP, Kamber-Shahdadkot and ASI Akhtiar Ali Jagirani on behalf of SHO PS Wagan.
Respondents No.3 to 7 are present in person.
---------------------
Mr. Imdad Ali Tunio, advocate, files Vakalatnama on behalf of respondents No.3 to 7, which is taken on record.
Through instant petitioner, petitioner has alleged harassment by the respondents, whereas it has been further stated that police is not providing protection.
Pursuant to Court notices, respondents No.3 to 7 have shown appearance. Statements have been filed by respondents No.1 and 8, whereas respondents No.3 to 7 have filed objections alongwith annexures, which are taken on record.
Counsel for the respondents No.3 to 7 states that the allegations as contained in the instant petition are false and frivolous, whereas no harassment whatsoever has been caused to the petitioner by the private respondents. It has been stated that in fact the brother of respondent No.3 has contracted marriage with the daughter-in-law of the petitioner with her own freewill and without any pressure or coercion, which has antagonized the petitioner, who has got false F.I.R No.71/2013 registered at Police Station Waggan for alleged abduction of her daughter-in-law, for which a petition has been filed before this Court. It has been further stated that in order to cause harassment and to pressurize the respondents instant petition has been filed by the petitioner.
The learned Counsel for the petitioner denies such allegations and submits that the respondents may be directed not to cause any harassment to the petitioner, whereas the police officials may be directed to provide protection to the petitioner in accordance with law and the F.I.R registered by the petitioner may be investigated properly.
The learned State Counsel has drawn the attention of this Court to the fact that in C. P. No.907/2013 filed by Mst. Fatima, daughter-in-law of the petitioner, before this Court, order has been passed, wherein the police has been directed not to arrest anyone nominated in the said F.I.R till next date of hearing.
Be that as it may, instant petition is being disposed of with directions to the respondents not to cause any harassment to the petitioner, whereas the concerned police is directed to provide protection, if required, in accordance with law. The order passed by this Court in the instant petition will have no bearing on the C. P. No.907/2013, which is pending before this Court.
Instant petition stands disposed of in the above terms.
