2.         Through instant petition, the Petitioner seeks recovery of her minor son Ismail son of Irfan.

Counsel says that in accordance with a Jirga Faisla which directed recovery of petitioner’s son for the reason that Petitioner was divorced by her husband, the son of Petitioner was kidnapped by the respondents and taken to Hango and, therefore, direction be given to police at District Hango, Khyber Pakhtoonkhaw to produce the boy before this Court.

We have asked the learned counsel as to whether an FIR of the incident has been registered, she says that the Petitioner tried to approach the Police Station but on one ground or the other she did not lodge the FIR. Since appropriate alternate efficacious remedy is available to the Petitioner, therefore, we while dismissing this petition observe that in case the petitioner approaches the concerned Police Station, her statement would be recorded in accordance with law and action accordingly be taken.
