                        This is an application in terms whereof  the order dated 12.08.2003 was challenged  in terms whereof the surety  amount of  Rs.200,000/=  was ordered to be recovered.  It is contended that the execution  for the recovery of said amount is pending  against the property of the deceased  which is now devolved upon the legal heirs of the surety.   The widow has  filed this application that after  the sad  demise of her husband she could not  pay said the  amount and the immovable property is the only property from where  they are earning livelihood.

                        Learned State Counsel   reluctantly agreed    that only to the extent of amount of 50% can be reduced however nothing less that could be acceptable to the State. 

                        Accordingly, with the consent of the State Counsel,  the amount of surety is  reduced  to 50%. The required amount to be paid  is Rs.100,000/= which shall be paid by the applicant within a period of three months.

                        The application stands disposed of in the above terms.
