            This is reference relating to transfer of case, in terms whereof it is stated that case was registered under section 323, 353, 427, 148, 149, PPC and 17 (3) Offences Against Property (Enforcement of Hadood) Ordinance, 1979. Learned State counsel submits that since Presiding Officer where the case is being tried i.e. 1^st Additional Sessions Judge is a non-muslim therefore, case could not proceed before the said Court. Accordingly this case may be tried by the District & Sessions Judge, Jacobabad himself.  Criminal transfer application stands disposed of in above terms.
