          The case of the petitioner is that he lost by 9 votes  on account of discrepancies in the tabulation of vote count.  This Court passed injunctive order for the reason that in the statement of vote count 457 votes of one Ali Sher Shah were attributed to Respondent No.4. However, it is pointed out by the respondent’s counsel that in fact these votes were bagged by Respondent No.4 and Ali Sher Shah was  his covering candidate who did not bag any vote. Counsel for the petitioner further argued that he has sought re-counting of all votes and verification of votes of 18 polling stations through NADRA.

 

All these matters are to be agitated before the Election Commission. Let the Election Commission decide application filed under Section 103AA of the Representation of Peoples Act,1974 within a period of 30 days. Let the Election Commission  notify the result and after hearing if it finds that the petitioner has bagged more votes, the Election Commission would be well within its rights and authority to denotify Respondent No. 4.  

With the above directions, this petition is disposed of.
