Learned Counsel for the respondents submits that the claim of the petitioners is based on the forged and fictitious documents. No such appointment was made by the E.D.O., and the petitioners are relying on the bogus documents and they never received any salary from the department. Learned Counsel for the respondents further submits that the appointments from BS-1 to BS-20 are made in accordance with law in terms of the public notice to be issued. No such policy or procedure has been adopted or at-least shown by the petitioners and that if at all such appointment letters were issued, then the question as raised by the learned Counsel for the petitioners touches the terms and conditions of service and this Court has no jurisdiction.
After hearing the parties, it is agreed by all present that let in the first instance an enquiry be conducted with regard to the documents/appointment letters of the petitioners. In case the documents turns out to be bogus and fictitious, the department may take action, however, in case it appears and reflects in the enquiry report that the petitioners were given appointment letters after following the procedure as laid down under the law, the petitioners may avail their remedy in accordance with law. Let Regional Director, Schools, Larkana Division be appointed to conduct the enquiry as aforesaid within 60 days.
Petition stands disposed of.
