            It is agreed by the learned counsel appearing for the appellant that this Court has no jurisdiction as for as the appeal is concerned, as it is to be filed before District & Sessions Judge. However, since the learned counsel has filed this appeal before this Court, it is agreed that he may avail his remedy before District Judge by filing an appeal. He is at liberty to move an application under Section 5 of the Limitation Act and the appellate Court may consider this ground that the appellant has filed appeal before this Court which has consumed time and that the same may be considered by the appellate Court while considering the application for condonation.

            The appeal stands disposed of.
