Learned counsel has relied upon the recruitment policy dated 3^rd July, 2008 in terms whereof the son/daughter of police officers are entitled for 05 additional marks irrespective of his eligibility and other educational qualities that they may or may not posses. Learned counsel is put on notice as to how this recruitment policy in terms whereof 05 additional marks are to be awarded to the son/daughter of police officer is lawful particularly, in terms or Article 4,8 and 25 of the Constitution of Islamic Republic of Pakistan as the award of 05 marks would not only negate the merit but also any competent and deserving candidate would suffer on account of these additional 05 marks just on account of the fact of not being son/daughter of the police officer. The candidate entitled for such additional 5 marks may or may not be competent yet entitled to such grace of 05 marks. Addition of 05 marks as computer literate in the same policy would certainly make sense as being an additional quality in the candidate however, grant of 05 marks to son/daughter of a police officer is not additional eligibility or quality. Since all candidates are being considered under one and only merit list there is no other separate list

for the sons/daughters of police officers therefore, this question is being framed as to how under one recruitment policy this award of 05 additional marks could be considered in accordance with law.
