5 & 6.  Learned Counsel inter-alia contended that petitioner has participated in tender process and as per PPRA rules, the works are to be awarded to the lower bidder but the respondents by violating the rules are issuing open tender forms to their favorite contractors, hence the petitioner has made a prayer that the respondents be directed to issue open tender form to the petitioner and to allow him to participate in tendering process as per rule, particularly he has deposited the amount payable at call and such statement has been filed. Learned counsel next contended that if the direction be given to the respondents to issue the open tender forms to the petitioner, the purpose of filing of this petition will be served and it may be disposed of. Undoubtedly, being a right of petitioner to participate in the open tendering process, the request made by the learned counsel is convincing. Order accordingly. However, issuance of such forms are subject to further orders and outcome of further proceedings.
