Mr. Imdad Ali Mashori, advocate for petitioner.

Mr. Ali Raza Pathan, State Counsel.

Today it has been pointed out by the learned counsel for the petitioner that the comments filed by the Deputy Commissioner, Kamber-Shahdadkot,  in para No.6, he has stated that the Government has released an amount of Rs.92.193 Millions for payment to the flood affectees of 2007, out of which payment  had been released to 277 flood affectees to the extent of Rs.4.155 Million, while there remains 88.038 Millions and this amount being insufficient  to make payment to remaining 10394 flood affectees, therefore, Government had moved to release more amount so that payment may be made to all remaining flood affectees. This is quite surprising and it is not sensible that the Deputy Commissioner is retaining the amount of Rs.88.038 Millions as it is not sufficient to 10394 flood affectees. Better sense should prevail and Rs.88.038 Millions which have been released by the Government should be distributed in  accordance with the law to the flood affectees instead of retaining the said amount and waiting for further amount to be released so that the entire flood affectees could be catered. That this formula was not applied when earlier 277 flood affectees were catered. This petition by consent is disposed of by directing the concerned officials including the Deputy Commissioner to provide financial assistance in accordance with the law as the sum of Rs.88.038 is being retained for the said purpose for the consumption of these flood affectees. Petition stands disposed of.
