                   Through this Constitutional Petition, petitioner Khadim Hussain has prayed for following reliefs :-

a)                 That, this Honourable Court may be pleased to direct the respondents No.1 to 3 not to cause harassment, not to issue threats of dire consequences and of implicating petitioner and his family members in series of false criminal cases and further be pleased to direct the respondent No.5 to conduct an impartial inquiry against the respondents No.1 to 3 and three other police officials and submit such report before this Honourable Court.

 

b)                 To direct respondents No.4 and 5 to take legal action against respondents No.1 to 3 and three other police officials as they have misused their official powers and further be pleased to direct incharge of Police Station B/Section Shahdadkot to record the statement of the petitiuoner and if from his statement cognizable offence is made out then his F.I.R may be registered.

 

c)                  To direct the respondents No.4 and 5 to provide legal protection to the petitioner party as per law.

 

d)                 To award costs of this petition to the petitioner.

 

e)                  Any other relief available under the circumstances may also be granted to the petitioner.

 

 

                   Notices were issued to the respondents as well as A.A.G.  Comments have been filed by respondents No.2 and 3. 

                   In the comments it is stated that allegations are false.  No harassment whatsoever has been caused.  Learned State Counsel states that official respondents are bound to provide legal protection to the petitioner in accordance with law.

                   Mr. Rafique Ahmed Abro, learned advocate for petitioner, submits that official respondents No.1 to 4 have misused their powers and committed high handedness.  Therefore, S.S.P., Kamber-Shahdadkot shall conduct enquiry against respondents No.1 to 4 at his level and compliance report shall be submitted to this Court within one month.  In these circumstances, learned advocate for petitioner does not press this petition more and it is disposed of accordingly.
