                        Through this transfer application the applicant/accused seeks transfer of the Sessions Case  re: State vs. Mushtaq Ahmed and another pending trial in the Court of learned 1^st Additional Sessions Judge Larkana.  The transfer application is moved on the ground that the Court of 1^st Additional Sessions Judge, Larkana is lying vacant since long.   Alongwith the transfer application,  the case diary dated 03.12.2012  has also been filed which shows  that Court is lying vacant.

                        Mr. Naimatullah Bhurgri, State Counsel   present in Court  in other matters waives notice of this  transfer application and recorded no objection in case matter is transfer to some other Court having jurisdiction in the matter.

                        In these circumstances,  Sessions Case No. 355 of 2011 re: State vs. Mushtaque Ahmed and another  arising out of Crime No.68/2011 U/S 353, 324, 412, 34 PPC  at P.S Waleed  is withdrawn  from the Court of 1^st Additional Sessions Judge, Larkana, which is lying vacant and same is madeover to the learned Sessions Judge, Larkana for disposal according to law.  Transfer application is allowed.
