                   Through this Constitutional Petition, petitioner has prayed for the following reliefs :-

 

a)                 That this Honourable Court may be pleased to direct the respondents No.1 to 44 to arrest the nominated accused of F.I.R No.16/2012 of PS Waleed and submit the report u/s 173, Cr.P.C before the competent Court of law.

 

b)                 Award costs of the petition.

 

c)                  Any other relief, which this Hon’ble Court deems fit and proper, be also awarded to the petitioner.

 

 

                   Notices were issued to the respondents as well as A.A.G.  Comments are filed by respondents No.1 & 3 to 5, in which it is stated that petitioner Ali Bakhsh lodged F.I.R at Police Station Waleed, Larkana.  It was recorded vide crime No.16/2012, under Section 302, PPC.  After usual investigation challan was submitted before the competent Court of law on 16.3.2012 showing accused Muhammad Khan Shar under custody and remaining accused were shown as absconders.

 

                   Learned advocate for the petitioner submits that he would be satisfied if trial Court is directed to make the efforts for arrest of the absconding accused. 

 

                   Request is quite reasonable.  I have also heard learned State Counsel.  Trial Court is directed to make all the possible efforts under the law for arrest of the accused who have been shown as absconders in the challan.  Learned trial Court may direct S.S.P., Larkana for deputing responsible police officer not below the rank of DSP to execute the N.B.Ws against absconding accused.  With these observations, petition stands disposed of accordingly.
