Mr. Imtiaz Ahmed Shahani, State Counsel, alongwith PSI Akhtar Hussain Burdi on behalf of S.S.P., Larkana.

                   Through this Constitutional Petition, petitioners have prayed for the following reliefs :-

a)                 That this Honourable Court may be pleased to direct the respondents No.1 to 3 to provide legal protection to the petitioners and family of petitioner No.2 against the high handedness of respondent No.4 to 11 the parents of petitioner No.1, as petitioner No.1 being ‘sui juris’ has contracted valid Nikah/marriage with the petitioner No.2 at her own freewill and consent without any pressure from any corner.

 

b)                 That this Honourable Court may be pleased to direct the respondent No.1 and 3 not to register any case/F.I.R against the petitioner No.2, his family and relatives at the instance of relatives of petitioner No.1.

 

c)                  This Honourable Court may be pleased to direct the respondents No.4 to 11, not to cause illegal harassment to the petitioners for return of petitioner No.1 to them, as the petitioners are lawful husband and wife.

 

d)                 That cost of the petition may also be awarded to petitioners.

 

e)                  Any other equitable relief under the circumstances may be given to the petitioners.”

 

 

                   Notices were issued to the respondents as well as Addl. A. G.  Comments have been filed by respondents No.1 to 3, in which it is stated that no harassment whatsoever has been caused to the petitioners, nor petitioners shall be harassed in future.  Every protection shall be provided to the petitioners, if and when approached to the concerned police. 

                   Mr. Imtiaz Ahmed Shahani, appearing on behalf of the official respondents, submitted that protection to the life and property of the petitioners shall be provided by the official respondents in accordance with law. 

                   In these circumstances, learned advocate for the petitioners does not press this petition more.  Therefore, petition stands disposed of in the above terms, with further direction that official respondents shall provide every protection to the petitioners and no harassment whatsoever shall be caused to the petitioners.  S.S.P., Larkana shall submit fortnightly report to the Additional Registrar of this Court regarding the safety and security of the petitioners in accordance with law for perusal.
