Learned counsel for the applicant/complainant Agha Abdul Majeed Khan Pathan, states that pre-arrest bail was granted to accused Shahbaz Khan alias Mashooque Khan by learned Sessions Judge, Shikarpur vide order dated 12.8.2012, accused was directed to appear before the concerned Civil Judge & Judicial Magistrate where it is stated that accused remained absent on the date of hearing. Complainant approached learned Sessions Judge, under section 497 (5), Cr.P.C for cancellation of the bail, but said application was dismissed on 04.2.2011. Grievance of Mr.Abdul Qadir Abro, advocate for the complainant is that learned Sessions Judge, has not ordered Civil Judge & Judicial Magistrate for issuance of non bailable warrants against the accused and for taking action against the surety in terms of section 514, Cr.P.C.
It is ordered that, learned Sessions Judge, Shikarpur shall issue directions to the Civil Judge & Judicial Magistrate concerned for proceedings against the accused and surety in the matter in accordance with law. Application is disposed of accordingly.
