The petitioner through this petition has prayed as follows :-
a) Declare that act of the respondents No. 1 to 10 in not issuing the pre-qualification letter in pursuance of Notice to Bid to be held in between 19.6.2012 to 27.6.2012 following submission of pre-qualification document is tainted with malice, ulterior motives, just to keep the petitioner away from carrying the lawful activities of trade and business.
b) Direct the respondents No. 1 to 10 to issue pre-qualification letter in response to prequalification documents submitted by the petitioner for Notice to Bid to be held in between 19.6.2012 to 27.6.2012.
c) Direct the respondents No. 1 to 10 to issue the RFP (Request for proposal) for the contracts specified in the Notice to Bid in order to enable the petitioner to participate in the bidding process.
Admittedly, the petitioner is not registered as a pre-qualified contractor with the respondent-authority, in terms of the Notice to Bid, the respondent-authority has sought bids from its pre-qualified firms for operation, management and maintenance of certain Toll Plazas.
As noted above, the petitioner is not pre-qualified with the respondent-authority and thus there is no question of their being allowed to apply for pre-qualification at this stage and/or to participate in the aforenoted process. The petition is wholly misconceived and untenable and is accordingly dismissed alongwith the pending applications.
