Learned counsel for the appellant submits that the only grievance of the appellant in respect of the impugned order is that though on 16.9.2010 CMA Nos. 2444/09 and 2445/09 were fixed for hearing however, the order for confirmation of the attachment as sought through these applications was made without the applications being taken up and without any hearing in respect of such applications.

Mr. Behzad Haider, learned counsel for respondent No. 1 concedes to the above and consents for an order for remanding the matter back to the learned Single Judge for hearing of CMA Nos. 2444/09 and 2445/09 so that appropriate orders may be passed after hearing of said two applications. Rest of the order shall remain un-affected by this consent order.

We would, therefore, dispose of the above appeal in the foregoing terms. It is however, clarified that the instant order shall not affect ad-interim order dated 17.03.2009 passed in respect of the aforesaid two applications.
