Counsel for respondent No.2 says that the petitioner is not pursuing the instant petition as no amended memo of petition in compliance of order dated 24.12.2009 till date has been filed. The record further reflects that on 21.02.2012 Mr. I.H. Zaidi has made a statement that the petitioner is not in contact with him and therefore he had taken a fixed date in order to discharge his obligation as counsel. However, today neither Mr. Zaidi is present nor any request is available on record. It is now 11:47 a.m. The petition consequently is dismissed on account of non-prosecution along with listed applications.
