3&4. Learned counsel for the petitioners contends that in C.P. No.D-3411/2011 following order has been passed by this Court:-

“3&4. Case of the petitioners is that all the purchases were made through cross cheques from active registered supplier listed with CBR, but criminal case has been registered against the petitioners on the ground that some fake sale tax invoices have been used. He contended that in case fake invoices has been used by any of petitioner’s supplier that has nothing to do with the petitioner.

Issue notice to the Respondents for 25.10.2011. In the meanwhile, no coercive action shall be taken against the petitioners on the basis of FIR No. 678/2011 dated 09.05.2011, till next date of hearing.

Learned counsel states that in the present case similar question is involved. Issue notice for 27.2.2012. In the meantime, no coercive action shall be taken against the petitioners on the basis of FIR No. 693-DCI/S.Tax/Fakeinput/2011 dated 12.5.2011, till next date of hearing.
