The respondents alleged that since the petitioner No. 1 is minor, therefore, cannot enter into a valid contract of marriage. On 23.12.2011, this Court directed the Medical Superintendent, CMC Hospital, Larkana, to examine the petitioner No.1 namely, Mst. Shehnaz and submit report about her age/puberty. Pursuant to Court directions the Medical Superintendent, CMC Hospital, Larkana, vide his report dated 28.12.2011, has opined as under:-

“According to patient she is menstuarating since she was 12 years old and she is married since one month. On examination patient conscious and well oriented. Breast well developed public and axillary hairs are also present and are also coarse. Vagina and vulva well estrogenised well formed. Hymen not intact. Slight bleeding P/vagine positive. She is pubertal.”

While confronted with such report the counsel for the respondent No.3 states that the respondents who are parents of petitioner No. 1 may be allowed to meet with petitioner No.1.  He however states that they have forgiven their daughter and want to live in peace and harmony with their daughter and son-in-law. The counsel for the petitioners has no objection and states that parents of the petitioner No.1 are at liberty to meet petitioner No.1 at the house of petitioner No. 2.

In view of hereinabove, the instant petition is disposed of.
