            The petitioner has impugned the construction of the flat unit at plot No.IV-B-2/13, Nazimabad No.4, Karachi, by the respondent No.2 Farhan Siddiqui. Various orders were passed and lastly on 17.11.2009 undertaking was given that the violation if any shall be removed. Consequently Nazir was appointed to inspect the premises. Nazir has submitted the report dated 17.12.2009 reporting that impugned unauthorized construction has been removed and the parking has been restored and only the land of stairs which seems to be 2.5 feet in violation is within the boundary of the plot is compoundable. Learned counsel for the petitioner states that since the violation has been removed and they are satisfied with the direction contained in the order. The petition have served its purpose, accordingly disposed of alongwith all pending applications. However, the respondents are directed to ensure that the construction if any is raised, strictly in accordance with Karachi Building Control Ordinance 1979 and Regulation 2002.
