It is inter-alia contended by the learned counsel for the petitioner that the order impugned is already subjudice before the Member, Board of Revenue, which is fixed on 04.02.2010 being Appeal No.01/2010 and if at all the petitioner is aggrieved by the order of the Member, Board of Revenue he may be permitted to take such action as permissible in accordance with law. Order accordingly.

Member, Board of Revenue, is directed to decide the appeal as expeditiously as possible and preferably within a period of three months.

The petition alongwith listed application is disposed of in the above terms.
