Ch. Muneer Ahmed advocate alongwith petitioner.

Mr. S. Ali Ahmed Shah, advocate alongwith respondent No.1 to 3.

Through instant petition, the petitioner has alleged that his minors children namely Faryal, Farah and Dolara have wrongly been detained by respondents No.2 and 3, his brother-in-law and father-in-law, against their willingness and will of the petitioner.

Notices were issued, pursuant to which respondent No.1 and minor children have appeared alongwith their counsel Mr. Ali Ahmed, in Court and filed objections/written statement, wherein allegations regarding wrongful detention of the minor children has been denied. It has been stated that petitioner himself left the respondent No.1 at her parents house alongwith three minor children and has now filed instant petition only to cause harassment to the respondent No.1. Respondent has also complained about the behaviour of the petitioner.

After hearing both the parties present in Court at some length, it appears that on account to some trifling disputes between the parties, relation between petitioner and respondent No.1 have become strained.

However, after some counseling both the parties appear to have realized that by continuing strained relation their matrimonial life will be ruined, whereas their children will suffer in this account. Both the learned counsel for the parties have also contributed towards making the parties realize this position, which efforts are appreciated. Petitioner present in Court states that he wants to take back her wife /respondent No.1 and his children and undertakes that he will make all possible efforts to provide them a respectable life, whereas respondent No.1 also undertakes that she will also make all possible efforts to avoid any dispute.

In view of such undertaking by both the parties in Court purpose of filing instant petition appears to have been achieved. Petitioner and respondent No.1 are at liberty to live their life as per their own free will and choice.

Accordingly, petition stands disposed off in above terms.
