Ms. Faiza Zia, Advocate for the petitioner alongwith petitioner Khalid Murtaz Mustafa and legal heirs Ms. Rana Hussain, Ms. Farah Ziauddin & Ghulam Kibria as well as two independent witnesses Afaq Jamal Hussain and Syed Waqar Hussain.

            Through this petition under Section 278 and 372 of the Succession Act 1925, the petitioner namely Khalid Murtaz Mustafa son of the deceased namely Nafees Fatima, requested for the issuance of Letters of Administration and Succession Certificate in respect of the estate of the deceased mentioned in the schedule of immoveable property at page 157 i.e. House No.5-E, 7^th Central Street, DHA, measuring 619 square yards and at page 159 about the moveable property in the form of shares detailed therein.

It appears that all the legal formalities including publication in the newspaper i.e. daily Jang dated 16.12.2009 appears to have been complied with and no objection whatsoever from any corner has been received so far. The attesting witnesses Afaq Jamal Hussain and Syed Waqar Hussain are also present in Court. No objection affidavit was also given by the other legal heirs. There is no impediment to grant Letters of Administration and Succession Certificate. Office is directed to issue the same as per rules and after proper verification.
