            The comments have been filed on behalf of KBCA stating that subject property was inspected which old ground + 1 floor residential property and no violation has been noted. On 14.04.2009 none was in attendance for the petitioner and the matter was adjourned as a last chance.

            Accordingly, this petition appears to have been filed for some extraneous consideration. It is stated that the photographs attached as Annexure 'D' is in respect of the some other property whereas the plot number mentioned in the petition have been examined and the allegations have been found to be incorrect.

            Under the circumstances, the petition is dismissed with cost of Rs.25,000/- to be recovered from the petitioner. Notice be issued for payment of the costs on the General Secretary Amir Saeed as mentioned in the title of the petition. Office is directed not to receive any public interest litigation till the deposit of the cost of this case.
