Through listed application the applicant/accused present in person states that the accused namely Muhammad Zahid was granted ad-interim pre-arrest bail by this Court on 27.12.2006 pursuant to which the applicant stood as surety and furnished lease deed in respect of Plot No.1511, Sheet III, Data Nagar, Orangi Town, Karachi and personal bond in the like amount on 16.01.2007. It is further stated that the learned Xth Civil Judge and J.M. Karachi Central, vide its order dated 25.01.2010 has stopped the proceeding under Section 249 Cr.P.C. and release the accused Muhammad Zahid without pronouncing any judgment either acquitted or conviction. It is further stated that the learned Xth Civil Judge has further observed that accused Muhammad Zahid is on bail and his bail bond stands cancelled and surety discharged. Accordingly, it is stated that the surety submitted before this Court is no more required, the same may be directed to be returned to the applicant/surety after proper verification and identification. Learned APG after perusal of record extended his no objection.

Accordingly, there seems no impediment in the grant of listed application, which is hereby allowed. Office is directed to return the surety/documents to the applicant/surety after proper verification and identification.
