Through instant petition the petitioner has complained non registration of F.I.R about the alleged incident stated in the instant petition by respondent No.1. Notices were issued to the respondents, pursuant to which respondent No.1 has filed his comments whereby it has been stated that since the petitioner has not approached for registration of F.I.R, therefore, the allegations contained in the instant petition are false and misconceived. Learned State counsel, in view of the comments filed by respondent, stated that if applicant will approach the concerned SHO, he will record his statement and if a cognizable offence is made out, register the case against the accused persons.
To this submission, learned counsel for the petitioner is satisfied and states that he will not press the instant petition if the respondent No.1 is directed to record statement of the petitioner and act in accordance with law.
Accordingly, petition is dismissed as not pressed however, with the direction to the respondent No.1 to record statement of the petitioner, and if a cognizable offence is made out to proceed further, strictly in accordance with law.
