                             -----------------------------

On a written complaint by Waheed Ali Bhutto from Central Prison, Larkana, was converted into petition.  On 4.2.2011, petitioner was produced in custody from the jail, who complained against high handedness of the police officials and stated that he has been falsely implicated in F.I.R. No.72/2010 of PS Hyderi, Larkana, under Section 13(d) of Pakistan Arms Ordinance.  The petitioner stated he has been implicated in crime No.71/2010 and crime No.72/2010 by SIP Abdul Rasool Bughio, who had not only maltreated him, but also robbed him of the cash amount, whereas crime No.201/2010 was registered against him at PS Civil Lines, Larkana by SIP Hussain Ali Kharal, S.H.O. of PS Civil Lines, Larkana.

In view of such statement of the petitioner, Mr. Anwar Ali Gopang, DSP Headquarter, Shikarpur was appointed as investigating officer with the directions to conduct investigation of crime No.71 & 72 of 2010, registered at PS Hyderi and also crime No.201/2010, registered at PS Civil Lines, Larkana and submit his report within 15 days.  Such report, dated 21.2.2011 has been submitted by DSP Anwar Ali Gopang.  On perusal of such report it appears that all the above-mentioned cases were found to be based on no evidence, whereas the disposal of the case was suggested as cancel “C” class.  The petitioner present in Court has intimated that pursuant to such enquiry report, he has been acquitted in all the above cases and has placed on record the orders dated 23.2.2011 and 24.2.2011 respectively.

In view of hereinabove facts, the petitioner states that he is satisfied.  However, as regards the high handedness on the part of the police officials he states that on intervention of the elders of the community he has forgiven the respondents.  Accordingly, the instant petition having served out its purpose is disposed of, however, with the caution to the respondents not to cause any harassment to the petitioner and to act strictly in accordance with law, failing which they will expose themselves to adverse orders by this Court.

Petition stands disposed of in the above terms.
