Mr. Khalid Iqbal Memon, advocate for the petitioners, alongwith the petitioners.

 

Mr. Azizul Haque Solangi, Asst. A. G., assisted by Miss Rubina Dhamrah, State Counsel, alongwith SIP Ali Hassan Jamali, ex-S.H.O. PS Sakrand, at present S.H.O. PS 60-Miles, District Shaheed Benazirabad.

                   Pursuant to Court notices, SIP Ali Hassan Jamali, ex-S.H.O. PS Sakrand, at present S.H.O. PS 60-Miles, District Shaheed Benazirabad, is present and denies the allegations mentioned in the petition.  He further states that he has not issued any threats to the petitioners.  He had only raided the house of the petitioners pursuant to Court directions, whereafter he is neither posted at P.S Sakrand, nor he has ever contacted with the petitioners. 

                   Petitioners present in Court state that respondent No.5 with connivance with SIP Ali Hassan Jamali, ex-S.H.O. PS Sakrand, are still causing harassment and issuing threats of dire consequences.  The learned Counsel for the petitioners states that looking at the nature of serious allegations an enquiry may be directed to verify the allegations of the petitioner against SIP Ali Hassan Jamali, whereas the petitioners will approach before the concerned S.H.O. for registration of F.I.R. against the private respondent No.5, namely, Zulfiqar Ali Rind for issuing threats to the petitioners.

                   To this submission, the learned Asst. A. G., extends no objection if the enquiry into the allegations is conducted by some impartial officer. 

                   Accordingly, D.P.O., Shaheed Benazirabad, is directed to conduct an enquiry into the allegations against SIP Ali Hassan Jamali, ex-S.H.O. PS Sakrand, at present posted as S.H.O. PS 60-Miles, District Shaheed Benazirabad and if he is found guilty of the alleged offence, to take action against him in terms of Police Order, 2002 and submit compliance report to this Court within 15 days through the Additional Registrar of this Court. 

                   The petitioner is at liberty to approach before the concerned S.H.O., who shall record the statement of the petitioner and if a cognizable offence is made out, proceed in accordance with law.

                   Instant petition stands disposed of in the above terms.
