                        On 07.02.2011 following order was passed by this court:

                        “Learned counsel says that order dated 13.12.2010 was passed, whereby the amount of surety was forfeited. The accused namely Aachar has expired. Under such circumstances, learned counsel was posed with a question as to what is the effect if the accused person on whose behalf surety stood as such, expires?  Learned counsel seeks time to assist this court.  Time is allowed.  Adjourned to 21.02.2011.  Needless to mention that as far as forfeiture of amount of surety   in respect of accused No.2 namely Manzoor is concerned, learned counsel for the applicant still require to satisfy that the order U/S 514 Cr.P.C passed by the trial Court is illegal and requires interference of this court.”

                        When this  case was called up in the morning, applicant and his counsel were called absent.   The same is the position now.  It is 11.11 a.m. No one is present on behalf of the applicant.  Applicant’s counsel  is also called absent.  There is no intimation.  It seems that applicant  has lost interest in this case.  Dismissed for non-prosecution.
