2.                Granted subject to all just exceptions.

3.                It is, inter alia, contended by the learned Counsel for the applicants that the applicants have been falsely implicated in the instant crime, as neither they were named in the F.I.R., nor any role was assigned to them, whereas their names have been mentioned in the challan in view of statements of P.Ws recorded u/s 161, Cr.P.C at later stage.  Learned Counsel states that they have surrendered before this Court and are willing to appear before the learned Sessions Judge, Kashmore at Kandhkot, seeking bail before arrest, hence prays that protective bail may be granted by suspending the N.B.Ws issued by the learned trial Court.

 

                   Learned State Counsel waives notice and extends his no objection to the grant of protective bail and suspension of operation of N.B.Ws issued by the trial Court against the applicants/accused.

 

                   Accordingly, the applicants/accused are granted protective bail for ten days from today subject to furnishing surety in the sum of Rs.100,000/- each with P.R bond in the like amount to the satisfaction of Additional Registrar of this Court.  In the meanwhile, the operation of the N.B.Ws issued by the learned trial Court against the applicants/accused for the next date of hearing is hereby suspended.  

 

                   Needless to observe that the operation of this order shall cease to have effect on expiry of seven days from today or when the applicants shall surrender before the learned Sessions Court, whichever occurs earlier.

 

                   The instant application stands disposed of in the above terms.
