                        Through instant petition, the petitioner  has leveled certain allegations against the respondents police officials complaining about the  outstanding bills towards meals  allegedly taken by the respondents from his hotel, however,  without making any payment. 

             Notices were issued to the respondents  who have filed their comments alongwith affidavits  wherein all the allegations  contained in the instant petition have been specifically denied.  It has been further intimated  that  since the petitioner is a notorious  persons  involved in  the illegal activities  therefore, he  has filed the instant  frivolous petition to save  himself from clutches  of law and to malign  the police officials malafidely.

            On 28.01.2011 when the  matter was taken up  for hearing   no one   was in attendance on behalf of the petitioner nor any intimation was received,   whereas  all the respondents  were  present in Court.   It was  intimated  that  the counsel for the  petitioner is not keeping well for quiet  sometime therefore,  direct  notices were directed to be  issued to the petitioner for the next date,  with caution that  if no body appears  on the next date, the matter may be dismissed for non-prosecution.  It appears that  notice was issued to the petitioner  for today’s date, however,  neither the petitioner nor his counsel are in attendance.   It appears that petitioner has lost interest in proceeding with the instant petition, which otherwise appears to relate to recovery of alleged outstanding amount towards respondents. 

             However, since neither petitioner nor his counsel is in attendance nor any intimation is received, therefore, instant petition is dismissed for non-prosecution.
