            During the arguments of the instant case it has transpired that similar petition was filed by the petitioner i.e. CP No.1763/2010 which was disposed of on 14.1.2011 in view of F.I.Rs No.228, 229 and 230 of 2009 registered at P.S Ratodero against the petitioner and his relatives and challan was submitted in the competent court of law. Learned counsel for the petitioner has  sought permission to approach before the competent court of law for the recovery of his alleged robbed articles. When the counsel for the petitioner was confronted as to maintainability of the instant petition on almost similar facts and with similar prayer the learned counsel has frankly conceded that under the circumstances he would not press instant petition provided he may be allowed to approach the competent court of law by filing direct complaint. For the purposes of seeking remedy against the grievances as per law no permission is required from any Court. The petitioner is at liberty to seek his remedy in accordance with law.

            Accordingly, instant petition is dismissed as not pressed alongwith listed applications.
