            Through instant transfer application, complainant has prayed for transfer of Sessions Case No.516/2008 from the Court of 3^rd Additional Sessions Judge, Dadu to any other Additional Sessions Judge, Dadu on the ground that allegedly local Zamindar namely, Mehtab Butt who is close relative of MPA of Taluka Mehar is supporting the accused persons and has stated that the learned trial Judge had taken education with him, therefore, accused persons will be acquitted from the charge.

             Comments were called from the trial Judge who vide his comments dated 14.01.2011 has specifically denied all the allegations.  It is reported that the matter is proceeding and the evidence is being recorded. However, he has stated that learned trial Court would have no objection if the case is transferred to some other court.

I have heard the applicant in person and perused the comments. It appears that no reasonable ground has been mentioned in the instant transfer application attracting the provisions of Section 526, Cr.P.C. Matter is proceeding before the trial Court in accordance with law and no allegation whatsoever about the conduct or otherwise except vague allegation, which have been specifically denied by the learned trial Judge have been raised.

            In view of the above, instant transfer application is entirely misconceived, the same is hereby dismissed.
