                   On 10.01.2011, at the instance of the Counsel for the applicant, directions were issued to the Superintendent, Central Prison, Larkana, to submit report about ailment condition of the applicant/accused, namely, Aijaz Ali Chano, as it was contended by the learned Counsel that the applicant/accused has suffered heart-attack in jail.  

                   Pursuant to such directions, the Superintendent, Central Prison, Larkana  vide his letter dated 20.01.2011 has submitted his report alongwith the report of Superintendent, Chandka Medical College Hospital, Larkana of the even date, wherein it has been stated that the applicant/accused has not suffered any heart-attack.  It is further stated that the above-named UTP appeared before the visiting Cardiologist at CMCH, Larkana on 18.01.2011, who has opined as under:-

At present no cardiac problem.  It is advised that he should undergo stress thalamium study at LINAR, for further evaluation.”

 

                   When the Counsel for the applicant was confronted with such position, he does not press the instant application, however, he requests that the applicant/accused may be provided medical treatment as advised by the doctor. 

                   Accordingly, instant bail application is dismissed as not pressed.  However, jail authorities are directed to provide medical treatment to the applicant/accused as per rules.
