                        None present nor any intimation received.  On 11.1.2011 also no one was in attendance on behalf of the petitioner.  However, matter was adjourned for today’s date with caution that if no body appears on the next date, the petition will be dismissed for non-prosecution.

                        Today learned State counsel  states that in view of the comments filed by the respondents, the petitioner did not qualify  on account of being overage.  

                        It is now 12.30.  It appears  that in view of the above legal position, the petitioner has lost interest to pursue this petition.  Accordingly, the instant petition is dismissed alongwith listed application for non-prosecution.
