None for the petitioner nor any intimation received. Mr. Imdad Ali Tunio, advocate has filed vakalatnama on behalf of respondents which is taken on record. Learned counsel for respondents states that F.I.R was registered and case was challaned and the matter is proceeding before the learned trial Court and is fixed for evidence on 12.2.2011. He further states that petitioner has filed frivolous and fictitious petition which is liable to be dismissed.

On 29.10.2010 when the matter was fixed for hearing no one was in attendance on behalf of the petitioner. Today also, no one is in attendance nor any intimation received. It appears that in view of the hereinabove facts as stated by the learned counsel for the respondents petitioner has lost interest in the instant case. It is now 12.15 p.m. accordingly, the instant petition is dismissed for non prosecution.
