Through instant petition, the petitioner has complained about the highhandedness on the part of the police officials, who as per petitioner raided his house on 2nd March 2010, his behave with petitioner and women folk and dragged them from house. It has been further alleged that while leaving the respondent also forcibly took away minor son of the petitioner Farzand Ali aged about 13/14 years.
Notices were issued to the respondents, who have submitted their comments wherein adverse allegations have been denied. It is reported that brother of petitioner namely Rustam Ali Chandio and his son are required in criminal cases and the police is trying to apprehend those culprits. The petitioner in order to save their skin has filed instant frivolous petition. Mr. Qazi Abid Hussain, P.S was appointed as Commissioner to pay surprise visit and submit his report as to who is in occupation of his house. The Commissioner has submitted his report dated 6th March 2010, wherein it has been reported that the police officials were found out side the house of the petitioner and on enquiry it was learnt that they have been deputed on the instructions of the high officials i.e DPO Kamber-Shahdadkot to occupy the house. The learned Commissioner has also reported about articles lying in the house.
Today the petitioner is present in Court along with his counsel and states that he has found his son namely Farzand Ali who is now with him. However, he states that his several house hold articles and buffaloes are still in the possession of the respondents police officials. The learned Addl. A. G states that these are the allegations, the respondents were performing their duties and were making efforts to apprehend the culprits and no illegal raid was conducted at the house of the petitioner nor house hold articles were taken away by the respondents as already stated in the comments filed by the respondents. Today also respondents have filed their comments in which they have denied the allegations. Learned counsel for the petitioner states that though the petition has served out its purpose. However, he states that since there are serious allegations against the police officials, the SHO Police Station Gaji Khuhawar be directed to record the statement of the petitioner and if cognizable offence is made out, to proceed in accordance with law. The learned Addl. A. G has no objection for disposal of the instant petition in the above terms.
Accordingly, the petition is disposed of in the above terms.
