1.                In view of the proposed order at serial No.4, the office objection has become infructuous.

2.                Granted.

3.                Granted subject to all just exceptions.

4.                Through listed application, the complainant of the instant crime has prayed for transfer of Sessions Case No.91/2008 from the Court of II-Additional Sessions Judge, Jacobabad to any other Court of competent jurisdiction at District Jacobabad, on the ground that evidence of all the prosecution witnesses except investigating officer and the medical officer has been recorded upto 9th March, 2010, whereafter neither process is being regularly issued, nor the I.O. or the M.O. have been examined by the learned trial Court.

 

                   Learned State Counsel states that this cannot a ground seeking transfer of the case.  However, he states that directions may be issued to the learned trial Court to dispose of the matter expeditiously.  To this submission, learned Counsel for the applicant has no objection, however, he states that the learned trial Court be directed to conclude the case within two months. 

 

                   Accordingly, the instant application is disposed of with the direction to the learned II-Additional Sessions Judge, Jacobabad to expedite the disposal of the case pending since 9th March, 2010 without any progress within two months and submit compliance report to the Additional Registrar of this Court thereafter. 

 

                   Application stands disposed of.
