                        It seems  that in order to avenge  Mst.Shabana, who at one stage  of time was the wife of the applicant,  FIR No. 119 of 2010 of P.S Market Larkana   was registered by him (the applicant) under Sections 363, 382, 506/2 PPC against Mst.Shabana  amongst others   with the allegation  that Aamna  his minor daughter   has been kidnapped by Mst.Shabana who is real mother of the latter.  Matter was investigated  thoroughly and report  thereof was submitted by the I.O who after looking into the matter  the same was disposed of under false B Class.   Aggrieved  by such order, present  criminal miscellaneous application was filed on the allegation that the investigating officer has been influenced   and the report that was submitted by him does not reflect  the real truth.  Similarly it was  alleged   that the Magistrate concerned did not look into the matter properly and disposed of    the case FIR in mechanical manner.  Today, report dated 31.1.2011  has been filed  by SIO P.S Market  wherein  it has been mentioned that the allegation as leveled by the applicant were looked  into afresh and in conclusion it was mentioned that the minor  daughter  of Mst.Shabana  and of the applicant  herein has  not been kidnapped  and she  is living  with her mother Mst.Shabana.

                        Above being the position, the application on the face of it is meritless and it seems  that the same was filed in order to browbeat  and to intimidate and harass  Mst.Shabana. 

                        This application is therefore, dismissed as such.
